Jan Dzierzgowski, Kazimierz W. Frieske – Family
Policy: a cost of democracy
In our text we try to analyze, what is the logic of the system of family
benefits and family tax expenditures in contemporary Poland and what
presumptions about beneficiaries does it entail. In our view, it is hard to say,
whether the aforementioned benefits are designed to support the income of the
poorest families, since, as a result of family tax expenditures and the way of
means-testing family benefits, quite a few beneficiaries are people of
relatively good income status. Our conclusion says, that this kind of
inconsistency is simply a cost of democracy, and social policy – especially when
it concerns families – should not be overly rational.
Adam Zych – The state and it’s role in shaping the
growth of national wages
The article is devoted to the practical aspects of the 1995 law on negotiations
relating to the increasing of average remunaration. Generally speaking the
author judges the law negatively, calling it even the dead letter of the law.
Hence - some proposals to make fundamental or even revolutionary changes in the
law. The most important proposal is undoubtedly to introduce the principle that
the settled at the beginning of the year rate of increase of remunarations
should refer to each worker employd in a company. According to the author –
workers should even have the right to aacount the employee after the end ote
year. Should the financial results of the company be better than those settled
during negotiations at the beginning of the year – workers had the right to
financial compesation. The State Labour Inspection should uphold the above rules
because trade unions are now very weak in Poland.
Janna Mucha – „Moral hazard” In health care
The following article will deal with the issue of moral hazard in the health
care system. In the case of the lack of immediate payment (or incomplete payment)
for health service provided, patients tend to abuse the benefit system demanding
extra services which exceed the necessary level in terms of quality. Also, it is
a common fact that they neglect to foster individual health responsibilities.
The author presents different types of abuse in this sphere, roots and
consequences of this phenomenon and ways of neutralizing the problem.
Karolina Czerwińska – Flexicurity – an approach to
regulating social and employment policies
This article aims at presenting flexicurity as an approach to regulating social
and employment policies. A brief introduction of flexicurity principles is
followed by a presentation of the three main definitions of the concept:
flexicurity as a strategy, a state of the labour market and an analytical tool.
Then, the Danish and the Dutch models are analysed as important examples of
application of flexicurity policy in practice. Finally, an integrated
flexicurity approach at the EU level is described.
Magdalena Pędziwiatr – Usage of temporary employment
regulations: a lots of difficulty
About 1994 the first temporary agencies started appearing at the polish labour
market. The needs of individuals involved in temporary relationship caused that
this form of employment to expand rapidly. Temporary employment was not
regulated by any acts of law and interests of temporary workers were not
protected. Therefore polish legislature enacted the Temporary Workers Employment
Act of 9th July 2003 as a mean of protection from breaching temporary workers’
rights. Since then the rules concerning temporary employment were introduced
into the polish legal system. The practice has shown that binding law is
ambiguous and not plain enough to use it without hesitation. Usage of this
regulation causes problems which have to be solved quickly. They generally refer
to duration of temporary employment, workplace safety and health condition, job
title and equal treatment in terms and conditions of employment as permanent
workers in the user firm. This article attempts to construe problematic rules
with regard to intention of the legislature and proposition of amendments made
by temporary agencies.
Irena Sawa – Relevance of termination of an
employment contract by an employer in the light of judical decisions of the
supreme court
In the following article I am trying to bring near the problems of
giving notice of termination of employment contracts. I concentrating the
attention of the reader mainly on employers’ dilemmas connected with statutory
obligation of giving reasons for submitted notices of termination. I am
presenting and discussing the most frequent reasons of termination of a contract
by notice, forming against the background of judicial decisions of the Supreme
Court. I am indicating that the radical change of view on the subject of the
legal aspect of a notice to terminate an employment contract has taken place
both in the doctrine and judicial decisions within the space of last years.
Monika Miedzik – Mobbing – the description of the
phenomenon In Poland
The paper the reports results of the study which focused on the
quantitive and qualicative illustration of mobbing phenomenon in the workplace
in different sectors of economy in Poland. The aim of the study was to get the
following information: the scale of the phenomenon in Poland, the identification
of sectors of economy which are at the highest risk of mobbing and the
identification of the most popular mobbing tactics. 643 adult workers employed
in different sectors of economy over the country responded to the survey. The
results of this survey show that almost 25% of the emploees responded that they
faced mobbing in the workplace.
